Recommendation for alignment of application of compliance obligations under the proposed regulations with the Federal Output-Based Pricing System (“OBPS”) covered facility criteria. A covered facility under the Federal OBPS emits a quantity of GHGs equal to or greater than 50,000 tCO2e per annum.
