Proposed amendments to section 90 of the Income Tax Act (Canada) released by the Department of Finance on August 19, 2011. These amendments propose new income inclusion rules in respect of loans made by foreign affiliates to related entities. Our submission will describe certain scenarios in which the proposed rules deem income inclusions in circumstances where it is not appropriate from a policy perspective. Our submission will suggest methods of narrowing proposed section 90 in a policy appropriate manner.
