If you lobby or will lobby in the future, the election may affect you. Here’s what you should know.

Registration and reporting requirements during an election campaign

The prime minister, ministers, and ministers of state, and their staff retain their status as designated public office holders during a federal election period.

They retain this status until a new Cabinet is sworn in by the Governor General. All registration and monthly communication reporting requirements under the Lobbying Act continue to apply.

As well, registration and reporting requirements continue to apply in relation to all communications with public servants, Senators and their staff.

Political work and senses of obligation 

If you do political work for the benefit of a person who is or becomes a public office holder, it’s important be aware of the rules related to a sense of obligation, including cooling-off periods. The Lobbyists’ Code of Conduct prohibits lobbyists from lobbying any official who can reasonably be seen to have a sense of obligation to the lobbyist.

Five-year post-employment prohibition on lobbying

A 5-year prohibition on lobbying applies to former designated public office holders (e.g. members of Parliament, ministers and their staff, etc.).

This prohibition begins the day you cease to occupy your functions as a designated public office holder.

We have a wonderful team of advisors available to assist lobbyists or anyone seeking information about compliance with the Lobbying Act and the Lobbyists’ Code of Conduct. Any discussion or correspondence that would take place would be confidential. 

We strongly encourage lobbyists to seek guidance from our Office based on the full set of facts of their circumstances.

We also offer info sessions which can be held virtually or in-person, to individuals or in groups. Sessions are available in English, French or bilingual.
