Industry Canada has a policy which effectively precludes the use of the Extended Ku band by DTH satellite providers. Our corporation believes that policy should be amended and,accordingly, has conducted meetings with officials at Industry Canada and the office of the Minister of Industry to discuss the need for a policy revision to allow DTH to use this spectrum.

Broadcasting Public Notice CRTC 2008-11, Canadian broadcasting in new media. In letters to Ministers and meetings with MPs, we argued against the CRTC's consideration of internet regulation -- in particular, we opposed a proposal to introduce a tax on the revenues of Internet Service Providers.
CRTC Proceeding on the Canadian Television Fund (CTF) Report to Heritage Canada
Pursuant to the Broadcasting Distribution Regulations, broadcast distribution undertakings (i.e.cable and satellite providers)were required to contribute a set amount of revenues to the Canadian Television Fund. The Fund is funded primarily by private sector, mandated contributions and contributions by the Federal government, which has a "Contribution Agreement" with the Fund.Our corporation challenged the appropriateness of the funding program - particularly with respect to accountability,governance and measurability of results. There was a CRTC process to consider issues surround the Fund's policies and operations. Our corporation participated in that proceeding and also discussed our proposals for Fund governance,accountability and operations with officials from the CRTC, Department of Canadian Heritage and officials from the office of the Minister of Canadian Heritage.

Copyright Act Amendments - New Legislation following Bill C-61, An Act to Amend the Copyright Act
Meetings with officials from Industry Canada and the Department of Canadian Heritage requesting that any proposed Copyright bill be balanced and responsive to the needs and demands of consumers, and promote innovation and the ability to maximize the use of new technologies.
Meetings with officials from the Department of Canadian Heritage and Industry Canada to urge the continuation of Canada's position at international meetings concerning a possible WIPO Broadcast Rights Treaty to ensure that Canada retains flexibility to maintain features of its domestic law that would require "exceptions" to any new WIPO Treaty.

CRTC Part II Licence Fees

The regulation sets out fees to be paid by broadcast licensees. "Part II Fees"under the Regulations are the subject of a current Court challenge. Meetings have taken place with officials to discuss the Part II Fees.
