In addition, our clients are interested in possible amendments that may be the subject of a bill or bills introduced in the Senate of Canada.
Both the Indian Oil and Gas Act and Regulations are presently the subject of litigation, including whether Canada has the constitutional authority to enact certain of the 2009 amendments made to the Act and any consequent new Regulations. For this reason, any further detail is subject to solicitor/client privilege.
Regulation
- Indian Oil and Gas Regulations; Our clients are interested in the following sections of the Indian Oil and Gas Regulations: 2 through 59 inclusive, and the Schedules. When Parliament approved the 2009 amendments to the Act, the Minister represented to Parliament that he had committed to amendments to the Regulations. Our clients are interested in these amendments to be proposed by the Minister. If the Regulations are replaced in their entirety, our clients are interested in the entire replacement Regulations. Both the Indian Oil and Gas Act and Regulations are presently the subject of litigation, including whether Canada has the constitutional authority to enact certain of the 2009 amendments made to the Act and any consequent new Regulations. For this reason, any further detail is subject to solicitor/client privilege.
- Our clients have a constitutionally protected interest in the bed and waters of the Bow River (Natural Resource Transfer Agreement Amendment 1946, Constitution Act 1946). The Province of Alberta has competing interests that may undermine the Navigation Protection Act and the Parks Canada Agency Act and negatively impact the rights of the Stoney Nakoda Nations.
