Amending the Excise Tax Act (ETA) - Amend the ETA to address the inequitable and inappropriate application of GST/HST on cross-border transactions involving agreements made under subsection 178.8(3) and (4). GST/HST under these provisions should be payable and collectible based on the province to which the goods are destined, not based on the province of the port of entry when the goods are imported into Canada.
Make this correction to the legislation and section 178.8 effective for all transactions occurring on/after July 1, 2010 – the date the Province of Ontario harmonized its provincial sales tax with the federal GST/HST system.
